Norwich Paddleboard Hire Limited cares for the safety and welfare of all Participants. We consider Health and Safety to be important for all Participants and require you to read and review this statement and indemnity form to establish our level of commitment to your health and safety. Participants must be a minimum of 6 years of age to hire a Paddleboard with parental consent. Participants under 18 years of age must be accompanied by a responsible adult on the Paddleboard. Participants under 18 years of age require an adult to remain with them throughout their hire. An Adult is someone over the age of 18. For any participant under 18 years of age, an adult must sign the disclaimer on their behalf. Your acceptance by signing below will act as your signature as a Participant and/or as the legal parent/guardian should the Participant be under 18. You must be over 18 to sign on behalf of anyone under the age of 18. Participants over 10 years of age must be confident in the water and able to swim 50m unaided in order to participate in these activities. You acknowledge water-based activities can be a dangerous activity.
Assumption of Risk: I understand and accept that renting this Stand up Paddle Board and participating in the water activities exposes me to many hazards and entails the unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in Stand up Paddle Boarding. I choose to participate in Stand up Paddle Boarding in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of renting this Stand up Paddle Board and participating in Stand up Paddle Boarding. I understand the inherent risk involved in using this equipment and accept full responsibility for any and all such damage or injury which may result.
Waiver & Release: In consideration of Norwich Paddleboard hire Ltd renting me this Stand up Paddle Board, I specifically release and forever discharge Norwich Paddleboard hire Ltd and its officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this Stand up Paddle Board and participating in Stand up Paddle Boarding. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of Norwich Paddleboard hire Ltd or its officer agents, or employees. It is my intent by the Waiver and Release Agreement to release Norwich Paddleboard hire Ltd and hold harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence of Norwich Paddleboard hire Ltd or whether based upon breach of contract, breach of warranty, or any other legal theory.
In signing this document, I fully recognize that if injury, illness, death or damage occurs to me or my party while we engage in renting this Stand up Paddle Board or participating in Stand up Paddle Boarding, I will have no right to make a claim or file a lawsuit against Norwich Paddleboard hire Ltd, its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage.
I REALIZE THE IMPORTANCE OF WEARING A LEASH AND I HEREBY COMMIT TO WEARING A LEASH AND LIFE JACKET AT ALL TIMES WHILE USING A NORWICH PADDLEBOARD HIRE STAND UP PADDLE BOARD.
I understand that this activity may result in severe injury, including but not limited to spinal or head injury. I understand that this activity may result in hazards posed by other water users and river or sea conditions and will abide by the navigational bylaws of the river network, namely the Broads. I understand how to operate the rental Stand up Paddle Board. Norwich Paddleboard Hire Ltd staff have answered any questions that I have.
I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
